Proposed Addendum to Law on Medical Aid and Service for Population Debated

The draft proposes to clearly state that the written consent is a necessary condition for medical intervention for the cases determined by the authorized body in order to exclude interpretations, legal uncertainties and contradictions existing in the law on Medical Aid and Service for Population. This requirement stems from the law on Normative Legal Acts, insufficient clarity, different understanding, as well as the need to clarify the issues arising in the field of application of the normative legal act. The RA NA deputy Emma Palyan informed about this.

On September 12, the parliament debated in the first reading two legislative drafts providing for the addenda to the law on Medical Aid and Service for Population authored by the deputies Narek Zeynalyan and Emma Palyan, as well as Narek Zeynalyan and Lusine Badalyan.

The reason for the addendum to the next law on Medical Aid and Service for Population is the protection of healthcare workers.

According to Lusine Badalyan, it is proposed adding a new paragraph to part 2 of Article 33 of the law.

The RA Deputy Minister of Health Armen Nazaryan noted that the adoption of the law with the proposed version will cause a disproportion in the financial, human resources and division of labor for medical institutions in the CPD process. Emphasizing the protection of healthcare workers, the Government proposed to revise the draft: to leave the regulation of the relations provided for in the labor contract, including the salary, to the mutual agreement of the employer and the healthcare worker.

According to Narek Zeynalyan, the draft was debated together with the Ministry and the interested parties. He noted that there are certain issues which will be debated during the period from the first to the second reading.

The Standing (Head) Committee on Health Care endorsed the debated drafts.
